10 Million fine and 10 Years Jail for handling unregistered medicines in Saudi Arabia


The Public Prosecution in Saudi Arabia confirmed that the procedures for registering medicines are achieved by the highest standards and the most accurate global requirements related to the safety, security and effectiveness of preparations before registration.



The Prosecution highlighted that it is not allowed in this regard to circulate any medicine or herbal preparation before registering it with the competent authority to protect health security and safety, as it is considered to have committed a major crime requiring arrest in accordance with criminal interests to protect public health. Anyone who sold, distribute, or owned with the aim to trade, or bringing into the Kingdom an unregistered pharmaceutical or herbal preparation, or try to introduce that, according to Article (34) of the law of establishments and pharmaceutical and herbal preparations.

- The Public Prosecution announced through an infographic on its official Twitter account, the penalty for trading pharmaceutical and herbal preparations before registering them with the competent authority, in accordance with Article 35 of the law of Facilities and Pharmaceutical and Herbal Preparations, and the penalties are, Imprisonment for a period of up to 10 years, and a fine of up to 10 million Riyals, and the temporary closure of the pharmacy facility for a period not exceeding 180 days. - The authority explained that according to Article (14) of the Health Professions Law, it is forbidden for the health practitioner to use detection or treatment devices that are prohibited in the Kingdom.

- The Public Prosecution stated that Article (7/28) of the Law on Practicing Health Professions stipulated that the penalty for this is imprisonment for a period of up to 6 months, and a fine of up to 100,000 riyals, or one of these two penalties.
