Ministry of  Human Resources in Saudi Arabia announces new Table of Violations and its penalties on three types of Employers


The Minister of Human Resources and Social Development in Saudi Arabia, Ahmed Al-Rajhi has approved new table of violations and its penalties, provided that they do not harm any more severe penalties mentioned in another law.







The new decision shall come into force from the date of its publication in Official Gazette on Friday, all previous decisions that contradict with the new table shall be cancelled. Trending : Saudi Crown Prince launches 75 billion riyals new master plan to develop Downtown Jeddah

- As per the new decision, financial violations are divided into 3 categories, according to the number of workers in the companies

1. For 51 workers or more

2. For 11 to 50 workers and

3. For 10 or less workers in the company.

Fine for non-compliance with Safety Rules :

The Ministry sets a fine of 10,000 riyals for the first category, 5,000 riyals for the second category and 2,500 riyals for the 3rd category, for non-compliance with the rules of occupational protection, safety and health measures approved by the Ministry for taking the necessary precautions to protect workers.





- In case the safety instructions are not set in Arabic and English languages for workers, the fine will be 5,000 riyals for first category, 2,000 riyals for second category and 1,000 riyals for third category.

- In case the worker does not comply with the preventive measures and the employer does not examine workers who are likely to be infected with an occupational disease, a comprehensive test once every year of her penalty is multiplied by the number of workers, so it will be 3,000 in first category, 2,000 for second category and 1,000 riyals for 3rd category. Fines on Medical Insurance and Child Labor :

If the employer does not provide medical insurance for the worker and his family members, as per the Cooperative health law, it will be penalized with 10,000 riyals in first category, 5,000 riyals in 2nd category and 3,000 riyals for the third, with multiple violations by the number of workers.





- Penalty for employing children who have not completed 15 years is 20,000 riyals for 1st category, 10,000 riyals for 2nd and 3rd category companies.

Fines related to Prayer place and Children's Nursery :

Penalty for employing women during the 6 weeks following the childbirth is set to 10,000 riyals for all category companies. The penalty is multiplied by the number of workers, while not providing seats for the number of workers for those work requires during working hours will be fined with 3,000 riyals in 1st category, 2,000 for second and 1,000 riyals for third. - In case of not providing a place for women workers and for men designated for prayer, rest and toilets as per the work environment, the fine will be 10,000 riyals for first, 5,000 riyals for second and 2,500 riyals for third category companies.





- If there is no place for childcare or nursery in the company that has 50 female workers or more, and the number for children of female workers under the age of 6 and or more the penalty is 25,000 riyals.

Fine for not complying in Compensation and Benefits :

An employer who does not comply with compensation and benefits in working hours, salaries or any other benefits for anyone who performs night duty, the penalty is 3,000 riyals for all categories. - In case of selling work visas or mediating visa sale, the penalty will be 20,000 riyals for each visa and it is same for all category companies.





Fines for not complying in Rest and Vacation :

A company that refuses it workers to grant a weekly rest as per the law or work contract or increase the number of working hours more that what is specified in Article 98 without providing over time work or not complying with daily rest periods granted to workers shall be penalized with 5,000 riyals for all category companies. It will be multiplied by the number of workers.

Time Limit to Object the violation or Pay the penalty :

- According to the new decision, the penalty prescribed for the violation committed by the violator can be objected with the competent authority in the Ministry within 60 days from the date of notification.
