Saudi Arabia implements Job Discipline Law, Know the penalties and exemptions of it


Saudi Arabia started the implementation of Job Discipline Law from Sunday, which comes as part of the Kingdom's efforts to modernize and develop laws, with the aim of protecting the public service, making sure the regular functioning of public department and the good performance of employee work.







It applies to all employees except those who work as per the regulations in which the penalty is regulated by the special rules and treated as per those rules and within the limits of its provisions.

New regulations :

The law stipulated the necessity of investigating the employee, hearing his statements and confronting him with violations before applying the penalty, and this is recorded in a report, the decision issued to impose the penalty is justified, provided that one or more committees are formed in each government agency whose role is to look into violations. - The system prohibits occupying the position of a person agains whom a judgement or decision has been issued to dismiss form service, whether it by appointment or contract or promotion or transfer, except after the decision has been protected by the expiration of the appeal deadlines or after the judgement has gained final status.





- Every employee who is proven to have committed a financial administrative or behavioral violation is considered as a breach of one of his job responsibilities, in this case the person shall be subject to penalty specified in the law, without prejudice to the right to file a public right lawsuit or a private right lawsuit.

Sanctions :

The Article 6 specifies the penalty that may be imposed on the employee, which is a written warning, deduction from his salary, not exceeding the net salary of 3 months, given that monthly deduction does not exceed one third of the net monthly salary. Recommend : Modifying salary requires the written approval from the employee

- Or the requirement of one annual bonus, or failure to consider his promotion no later than 2 years from the date of his entitlement to promotion or dismissal from service.




Exemption from Penalty :

- As per the Article 7, The employee can be exempted from the penalty, if he is proven that he committed the violation in implementation of an order issued by his superior, instead the employee alerting his boss of the violation in writing or by any of the methods considered legal.

- According to the Article 8 of Job Discipline Law, in cases other than death or total health disability, the employee's service termination does not prevent him from taking the measures specified in the law, or continuing with them.
