Saudi Arabia now prohibits Handcuffing of arrested Person except in these Cases
It is now illegal to handcuff an accused person upon his arrest in the Kingdom of Saudi Arabia, unless there are some exceptional circumstances, according to new regulations authorized by higher governing bodies. Trending : Saudi Arabia abolishes death penalty for crimes committing by minors
This was decided in a cabinet meeting presided over by King Salman, who approved the legislative amendment related to criminal procedures. The accused shall have the right to seek the assistance of an agent or counsel during the investigation and trial stages.
- This change was implemented by adding a paragraph to Article 21 of the Executive Regulations of the Criminal Procedure Law, which deals with protecting the rights of the person being accused.
- Now the law does not permit handcuffing the arrested person, except in two cases. A person is not need to be handcuffed when arrested under the new law unless there is a threat of physical harm to himself or others, or is committing an attack or tries to flee from authorities, or both. - The authorities have the power to take necessary steps to overcome any form of resistance during and without arrest. They also have the right to examine the arrested person. Any weapons or objects in the defendant's possession that could be used in self-defense or harm to himself or others must be removed and immediately accounted for.
- According to the sources, the decision to put restrictions on the voluntary ability of criminal investigation agents to handcuff individuals was based on a study of such incidents.
