New amendments to Saudi Labor Law, includes Notice Period, Leaves, Probation period


The Saudi Cabinet has approved extensive amendments to the Saudi Labor Law. The new amendments of Saudi Labor Act include modifications to 38 articles, removal of 7 articles, and the addition of 2 new articles to the labor law. The amendments considered the interests of all parties involved in employment contracts and included expanded sections on leaves (vacation) and contract works. Definitions for the terms "resignation" and "grievances" were added, along with an article outlining resignation procedures and modifying grievance procedures for workers. Penalties were introduced for engaging in worker recruitment activities without a license from the ministry.

* Sibling death leave : In case of death of the worker's sibling (brother or sister), the worker shall also be given leave with pay for 3 days (Earlier, it was only 1 day).

* Maternity Leave : Maternity period increased to 12 weeks (Earlier, it was 10 weeks).

* Notice period : If the employment contract is to be terminated, the employee must give 30 days prior notice. While, the employer must give 60 days prior notice. See Also : 6 types of Leaves in Saudi Labor Law

* Training period : The probation period shall in no case exceed 180 days.

* Paid Leave for Overtime hours : The reform also included the possibility for the worker to agree to take paid leave instead of wages for overtime hours.

* The new amendments also stipulate that employers must provide a training and qualification policy to enhance workers skills and improve their proficiency.

These amendments are designed to strengthen the proposal to develop existing systems and regulations that contribute to support the market, production and service sectors, besides providing an appropriate legislative environment and supporting small and medium enterprises with the aim of creating more jobs.

It aims to create a more attractive work environment in line with the goals of Saudi Vision 2030 and contribute to achieving sustainable development.
